These Terms of Use ("Terms") apply to www.coachhayward.co.uk and to the services, content, communities, memberships and coaching offered by Coach Hayward ("we", "us" or "I"). By using our website, signing up to anything we offer, or working with us, you agree to these Terms. If you don't agree with them, please don't use the site or our services.

We may update these Terms from time to time. The version on this page is always the current one, and continuing to use the site or our services means you accept any changes.

Health and medical disclaimer

This is the most important part, so please read it carefully.

Coach Hayward provides health and fitness education, coaching and lifestyle guidance. We are not a medical service, and nothing we provide is medical advice, diagnosis or treatment. Our content, coaching, blood work guidance and any recommendations are for educational and informational purposes only.

We don't replace your doctor or any qualified medical professional. Always speak to a suitably qualified professional before making changes to your health, diet, training, supplements or medication, and never ignore or delay medical advice because of something we've shared.

You take part in our coaching and use our guidance at your own risk, and you're responsible for your own health decisions. If you have a medical condition, are pregnant, are taking medication, or have any concerns, get medical clearance before starting.

Results are not guaranteed

Health and fitness results vary from person to person, and depend heavily on your own circumstances, effort and consistency. Any testimonials or examples we share are individual experiences and are not a promise or guarantee that you'll get the same outcome. They reflect exceptional results, not typical ones, and should not be taken as a guarantee of any specific result.

Who can use our services

Our website and services are intended for people aged 18 and over. By using them you confirm you're at least 18.

Coaching, memberships and bookings

When you buy a coaching package or membership, or book a call or assessment, you're entering an agreement with us for that service. The specific details of what's included, the duration and the price are set out at the point of purchase and in any coaching agreement you sign. Where a separate coaching agreement applies, that agreement and these Terms work together.

We reserve the right to decline to work with anyone, and to change or stop offering a service or feature. Prices can change at any time, though changes won't affect something you've already paid for.

Payments, refunds and cancellations

Refunds. We do not offer refunds once a coaching package, consultation or membership has been purchased. Please make sure you're ready to commit before you buy. This does not affect any rights you have under the law that cannot be excluded.

Cancellations. How you cancel depends on what you're on:

Coaching packages and manually managed memberships, including post-coaching memberships handled by our team, require 30 days' notice to cancel, in line with your coaching agreement. To cancel or make a change, contact us directly at jamie@coachhayward.co.uk and we'll talk you through your options and handle it clearly. There's no pressure and no judgement, the aim is just that your decision is an informed one.

Memberships managed through Skool, our free and paid community memberships, are cancelled or changed directly inside your own Skool account settings. Once cancelled, paid access continues until the end of your current billing period. We don't manage these manually.

Acceptable use

When using our website, community or services, you agree not to:

Use them for any unlawful purpose, or to encourage unlawful acts.

Harass, abuse, threaten or discriminate against anyone.

Submit false or misleading information, or impersonate someone else.

Upload viruses or malicious code, or try to interfere with or break our security.

Scrape, harvest or collect other people's information.

Copy, resell or exploit our content or services without our written permission.

We can suspend or end your access if you break these Terms.

Our content and intellectual property

The content we create, including our videos, courses, programmes, written material and resources, belongs to us. You're welcome to use it for your own personal health, but you may not copy, share, resell or republish it without our written permission.

Your submissions

If you send us ideas, feedback, questions or post in our community, you're responsible for what you share, and you agree it won't be unlawful, abusive or infringe anyone's rights. We may use, edit or remove submissions where we reasonably need to, and we're not obliged to keep them confidential or to pay for them.

Third-party tools and links

We use third-party tools and may link to third-party sites that we don't control. We provide access to them as a convenience, "as is", and we're not responsible for their content, accuracy or practices. Please review their own terms and policies before using them.

Disclaimer and limitation of liability

Our website and services are provided "as is" and "as available". We don't guarantee they'll always be uninterrupted, error-free or that any particular result will be achieved. To the fullest extent permitted by law, Coach Hayward and anyone working with us won't be liable for any indirect, incidental or consequential loss arising from your use of, or inability to use, our website or services. Nothing in these Terms limits any liability that can't be limited by law.

Indemnity

You agree to cover us for any reasonable claims, losses or costs that arise from your breach of these Terms or your misuse of our website or services.

Governing law

These Terms are governed by the laws of the United Arab Emirates, where our business is based. If you're a consumer in another country, this doesn't remove any mandatory legal protections you have where you live.

Changes to these Terms

We may update these Terms from time to time. When we do, we'll update the date at the top, and continued use of the site or our services means you accept the changes.
